Client Agreement & Terms of Service

Thank you for choosing The Main Street Website Company.
My goal is to make building your website as simple, straightforward, and enjoyable as possible. This agreement explains what you can expect from me, what I ask from you, and how we’ll work together throughout your project.
By requesting services, accepting a quote, placing an order, or submitting payment, you acknowledge that you have read, understood, and agree to these terms.
PAYMENT
To begin your project, I require:
- Payment in full for any third-party services purchased on your behalf, including domain registration, web hosting, premium themes (if requested), premium plugins (if requested), stock photography (if requested), or any other products or services purchased specifically for your project.
- A non-refundable deposit equal to fifty percent (50%) of your quoted project price.
Work will begin after these payments have been received.
The remaining balance is due once your website has been completed and approved, and before your website is transferred, published, or final files are delivered.
PROJECT PRICING
All quoted prices are base project prices.
If additional work is requested after a quote has been accepted, additional charges may apply.
Examples include:
- Additional pages
- New features
- Extra graphics
- Additional copywriting
- Major design changes
- Functionality not included in the original quote
- Extensive revisions
- Any work outside the agreed project scope
Whenever possible, any additional charges will be discussed and approved before work begins.
REVISIONS
Unless otherwise stated in your quote, each project includes up to two (2) reasonable rounds of revisions.
Additional revisions may be billed as additional work.
WEBSITE MAINTENANCE
Building your website and maintaining your website are two separate services.
Once your website has been completed and delivered, future maintenance is billed separately unless otherwise agreed.
Maintenance includes, but is not limited to:
- Content updates
- New pages
- Plugin updates
- Theme updates
- WordPress updates
- Security updates
- Backups
- Bug fixes
- Website improvements
- Technical support
- General website administration
I’m always happy to help after launch.
DOMAINS & HOSTING
Domain registration and web hosting are not included in the base project price.
If you do not already have a domain name or hosting account, I’ll gladly research reliable providers, recommend the best solution for your needs, register your domain name, and purchase your hosting on your behalf using the funds you provide.
I’ll always recommend the solution I’d choose if I were building the website for my own business, balancing quality, reliability, and value.
Your domain name and hosting account will always be registered in your name whenever possible.
If you already have a domain name, hosting account, website, or other existing services, I may require temporary access to your hosting control panel, WordPress administrator account, domain registrar, DNS management, FTP or SFTP account, or any other services necessary to complete your project.
ACCOUNT OWNERSHIP
Your website belongs to you.
Your domain belongs to you.
Your hosting belongs to you.
Your email accounts belong to you.
Upon completion of your project, you will receive all usernames, passwords, login information, and account details relating to your website.
I will not retain your passwords or login credentials unless you specifically request that I do so for future maintenance or support.
YOUR CONTENT
Everything you provide remains your property.
This includes, but is not limited to:
- Logos
- Photographs
- Videos
- Documents
- Written content
- Branding
- Business information
- Artwork
You are responsible for ensuring you have the legal right to use all materials you provide.
Unless you request otherwise, I will permanently delete copies of your materials after your project has been completed.
If you would like me to retain copies for future updates or maintenance, I’m happy to do so.
MY WORK
Once your project has been paid for in full, everything I create specifically for your website becomes your property.
This includes:
- Website design
- Custom graphics
- Custom code
- Theme customization
- Original written content created specifically for your website
Once final payment has been received, you may use, modify, transfer, or otherwise manage your website however you choose, subject only to applicable law and any third-party software licenses.
I do not claim ownership of work that has been fully paid for.
PROJECT TIMELINES
Project timelines depend upon receiving the information needed to complete your website.
Delays in providing text, photographs, approvals, or requested information may delay project completion.
If a project becomes inactive for sixty (60) days due to a lack of communication or missing information, it may be considered abandoned.
Resuming an abandoned project may require a revised quote.
CLIENT RESPONSIBILITIES
You agree to:
- Provide accurate information.
- Respond to questions in a timely manner.
- Supply requested content.
- Ensure you have permission to use all provided materials.
- Review completed work promptly.
- Clearly communicate requested changes.
LIMITATION OF LIABILITY
While I make every reasonable effort to provide dependable service, I cannot guarantee the availability or performance of third-party providers.
This includes:
- Hosting companies
- Domain registrars
- Email providers
- Payment processors
- Third-party themes
- Third-party plugins
- Software developed by others
I am not responsible for outages, software bugs, security incidents, pricing changes, or policy changes caused by third-party services.
PROJECT CANCELLATION
If you choose to cancel your project after work has begun, payments already made are non-refundable.
If work completed exceeds the value of your initial deposit, you may be invoiced for completed work performed before cancellation.
RIGHT TO DECLINE SERVICE
I reserve the right to decline any project before work begins for any reason.
GOVERNING LAW
This agreement shall be governed by the laws of the State of Missouri.
ACCEPTANCE OF TERMS
By requesting services, accepting a quote, placing an order, or making any payment to The Main Street Website Company, you acknowledge that you have read, understood, and agree to these terms.
These terms constitute a legally binding agreement between you and The Main Street Website Company.
